General

1.1. These terms and conditions (“Terms”) apply to orders, sales and deliveries of products (“Products”) offered and sold in this online shop (“Shop”) via the website https://theinvisibleplot.com/.
1.2. The language of the contract is English.

2.1. These Terms apply where the buyer is a consumer within the meaning of § 1 of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG) (“Customer”).

3.1. The Seller reserves the right to amend these Terms. The sale of Products is governed by the Terms in force at the time the order is placed.

4.1. To order Products, the Customer may create a customer account in the Shop. Creating an account requires the Customer to provide certain information. Orders can also be placed without a customer account.

5.1. The ordering process consists of the following steps:
– Selecting the desired product
– Adding the product to the basket
– Entering personal details
– Selecting the payment method and delivery method
– Reviewing the order once more and correcting it if necessary
– Submitting the binding order by clicking the button “Place order” (or an equivalent wording indicating an obligation to pay)
5.2. The Products and prices shown in the Shop constitute an invitation to the Customer to submit a binding offer to the Seller to purchase the Products (“Order”). By clicking the button “Place order”, or an equivalent wording, the Customer submits a binding Order to the Seller. Images and drawings of the goods are approximations only, unless expressly stated as fixed values for a product. The Customer accepts minor and objectively justified deviations.

5.3. The Seller will promptly send the Customer, to the e-mail address provided, a confirmation that the Order has been received (“Order Confirmation”). The Order Confirmation does not constitute acceptance of the Customer’s Order; it merely confirms that the Order has been received by the Seller.

5.4. Depending on the payment method chosen, acceptance takes place at different times and in different forms:
– by sending an order acceptance by e-mail, in which case the time at which the Customer receives the order acceptance is decisive;
– by dispatching the ordered goods to the Customer, in which case a shipping confirmation sent to the Customer counts as order acceptance. If no separate shipping confirmation is sent, receipt of the goods by the Customer is decisive.
5.5. The Customer must ensure that all information provided in the course of an Order, in particular the data required for shipping, is accurate, correct and up to date. The Customer must inform the Seller of any changes to this information without delay.

If the Products cannot be delivered because the information provided by the Customer is incorrect or incomplete, the Customer bears the resulting additional shipping costs.

5.6. After conclusion of the contract, the Seller sends the Customer an electronic invoice. The Customer agrees to receive an electronic invoice.

5.7. Products are produced shortly after the Order is placed. If the Customer asks to cancel an Order before it has been dispatched, the Seller will try to stop production and refund the full amount, but cannot guarantee this. The Customer’s right of withdrawal is not affected.

6.1. All prices are stated in euros including value added tax (VAT) but excluding shipping costs, unless stated otherwise. Shipping costs are shown to the Customer before the Order is placed.
6.2. Payment in the Shop can be made using the following payment methods: credit card, Apple Pay, PayPal, Google Pay, EPS bank transfer.
6.3. Shipping costs depend on the Order and are shown by the Seller before the Order is placed and in the Order Confirmation.

6.4. For deliveries to countries outside the European Union, no Austrian VAT is charged; in this case, the total price shown before the Order is placed does not include VAT. Import duties and taxes (e.g. customs duties, import VAT) and fees charged by the carrier may apply in the country of destination. These are not included in the purchase price and are borne by the Customer.

Delivery

7.1. The shipping methods stated by the Seller in the Shop are available to the Customer.
7.2. Delivery dates stated by the Seller are based on information from the shipping carrier. Unless a different delivery date is stated for a product, delivery to the Customer takes no longer than 30 days from conclusion of the contract.
7.3. If a delivery date cannot be met due to force majeure, industrial action or other events beyond the Seller’s control, the

delivery date is extended appropriately for the duration of the impediment. The Seller will inform the Customer of the beginning and end of such circumstances as soon as possible; the Customer cannot derive any claims from a failure to do so.
7.4. If the Customer is in default of accepting the Products, the warranty period for the Seller’s performance begins to run.

Retention of title​

8.1. The Seller retains ownership of the Products until the purchase price and ancillary costs (in particular shipping costs) have been paid in full by the Customer.

9.1. If the Seller is in delay, the Customer must first ask the Seller to perform within a reasonable grace period of two weeks. If the Seller does not perform within this period, the Customer may withdraw from the contract or continue to demand performance.

Warranty

10.1. The Invisible Plot provides warranty in accordance with the statutory provisions. For complaints, please contact info@theinvisibleplot.com.
10.2. The Seller may ask the Customer to send the defective Products to the Seller, where this is reasonable for the Customer; in that case the Seller bears the risk of shipment and the cost of return. The Customer is asked to report goods with obvious transport damage to the carrier and to inform the Seller. Failure to do so has no effect on the Customer’s warranty rights.

10.3. To report a defective, damaged or misprinted Product, please e-mail info@theinvisibleplot.com with the order number and photographs of the Product and its packaging.

Liability and damages

11.1. The Seller’s liability for damage caused by slight negligence is excluded, except for personal injury and breach of essential contractual obligations. Liability is also excluded for pure financial loss, loss of profit, damage to third parties, indirect damage and consequential damage. The limitations and exclusions of liability in this section 11 do not apply where the Seller has acted with gross negligence or intent.

General provisions

12.1. Unless Austrian law already applies, Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
12.2. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.

12.3. The Customer may only set 

off claims against the Seller’s claims if those claims are legally connected with the Seller’s claims, have been acknowledged or have been established by a court.
12.4. The Customer must inform the Seller of any change of address. If the Customer fails to do so, a declaration sent by the Seller to the most recently provided address is deemed to have been received.

Right of withdrawal

Under Austrian law this right is called “Rücktrittsrecht”; in EU law and in Germany it is called “Widerrufsrecht”. Both terms mean the same. In this information we use the term “right of withdrawal”.
Scope of the right of withdrawal. The right of withdrawal applies to all products offered in the Shop. Although the products are only produced after the order has been received, the Customer selects them from a predefined range (design, cut, size, colour); they are not made to the Customer’s specifications.
Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the last goods.
To exercise your right of withdrawal, you must inform us — The Invisible Plot, Poststraße 1/2, 5310 Mondsee, Austria, Tel.: +43 664 51 433 51, E-mail: info@theinvisibleplot.com — of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but this is not required.
You can also exercise your right of withdrawal online at https://theinvisibleplot.com/withdrawal/. If you use this online function, we will promptly send you, on a durable medium (e.g. by e-mail), an acknowledgement of receipt with information on the content of your withdrawal statement and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us or to The Invisible Plot, Poststraße 1/2, 5310 Mondsee, Austria, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
